1. Nature of Content & Accuracy

Freshcipe is a professional culinary platform intended for informational and inspirational purposes only. While we strive for accuracy, our content reflects personal experience and traditional methods.

  • Human-in-the-Loop: While AI may assist with styling, all instructions, temperatures, and measurements have been reviewed by a human for accuracy before publication

2. Intellectual Property

Unless otherwise stated, all content, including text, recipes, and original photography, is the property of Freshcipe and is protected by copyright laws.

  • Personal Use: You may print recipes for your own personal, non-commercial use.
  • Prohibited Use: You may not republish, sell, or redistribute our content or photography as your own without express written permission.
  • Copyright Scope: We own the creative expression of our recipes (the stories and specific instructional wording) and all photography. You acknowledge that under U.S. law, basic ingredient lists themselves are generally not copyrightable.
  • Permitted Use: You may print recipes for personal, non-commercial use only. Republication or redistribution requires express written permission.

3. Photography and AI Disclosure

All food photography on Freshcipe features real dishes prepared according to our actual recipes.

  • Visual Styling: We utilize digital enhancement and AI-assisted tools exclusively for aesthetic background settings and visual styling.
  • Accuracy: Our priority remains the visual accuracy of the food itself to ensure you have a realistic expectation of the recipe outcome.

4. User Contributions & License Grant

The Services may allow you to post text, photographs, comments, or reviews (collectively, “Contributions“).

  • Public Visibility: Contributions are non-confidential and will be viewable by other users and third-party sites.
  • License Grant: You grant Freshcipe an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, and worldwide right to use, copy, reproduce, publish, and exploit your Contributions (including your name and likeness) for any purpose, including commercial advertising.
  • User Warranties: You represent that you own your Contributions, they are accurate, and you have permission from any identifiable person in your posts.
  • Termination: Violation of these terms may result in the immediate termination of your rights to use the site.

5. Prohibited Activities

As a user, you agree not to:

  • Data Scraping: Systematically retrieve recipes or photos to create a database without our permission.
  • Security Interference: Circumvent or disable security-related features or attempt to learn sensitive account info.
  • Malicious Software: Upload viruses, Trojan horses, or repetitive text (spamming).
  • Harassment: Use site information to harass or harm another person or our employees.
  • Commercial Misuse: Use the site for any unauthorized commercial enterprise.

6. Third-Party Links, Advertisers, & Monetization

  • External Links: We are not responsible for the content or privacy practices of third-party websites we link to.
  • Affiliate Disclosure: Freshcipe participates in affiliate marketing programs and may earn a commission on purchases made through certain links at no cost to you.

7. Modifications, Interruptions, & Data

  • Service Availability: We cannot guarantee 100% uptime and are not liable for any loss or inconvenience caused by site downtime.
  • User Data Backups: While we perform routine backups, you are solely responsible for all data you transmit. We have no liability for the loss or corruption of such data.

8. Limitation of Liability & Disclaimer

  • Food Safety: You are solely responsible for ensuring proper food handling, avoiding cross-contamination, and reaching safe internal cooking temperatures.
  • “As-Is” Basis: Freshcipe is provided on an AS-IS basis. Use of the site is at your sole risk.
  • Safety Responsibility: You are solely responsible for food safety (temperatures/handling) and kitchen safety.
  • Liability Cap: To the maximum extent permitted by law, Freshcipe’s total financial liability for any claim is limited to the amount you paid us in the last 12 months or $100.00 USD, whichever is greater.

9. Age Restrictions

Freshcipe is intended for users aged 13 and older. Users under 18 should only use the site and prepare recipes under the direct supervision of a parent or guardian.

10. Governing Law & Dispute Resolution

  • Governing Law: These terms are governed by the laws of the State of New York, USA.
  • Informal Negotiation: Parties agree to attempt to resolve disputes informally for 30 days via freshcipe2025@gmail.com.
  • Binding Arbitration: Unresolved disputes will be settled by binding arbitration under AAA Rules in Monroe, New York. YOU WAIVE THE RIGHT TO A JURY TRIAL OR CLASS-ACTION PROCEEDING.
  • Time Limit: Any claim must be filed within one (1) year after the incident occurs.

11. Electronic Communications & Signatures

Visiting the site or completing forms constitutes electronic communications. You agree that all electronic agreements, notices, and disclosures satisfy any legal requirement that such communication be in writing. You hereby agree to the use of electronic signatures and records.

12. California Users

13. Miscellaneous

These Terms constitute the entire agreement between you and Freshcipe. If any part of these Terms is deemed unlawful or void, that part is severable and does not affect the validity of the remaining provisions. Freshcipe does not currently charge VAT; should this change, a VAT number will be provided here.

14. Privacy Policy

By using Freshcipe, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms. Please be advised the Services are hosted in the United States. If you access the Services from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in the United States, then through your continued use of the Services, you are transferring your data to the United States, and you expressly consent to have your data transferred to and processed in the United States.
